Opinion No. 47-5013

April 23, 1947

BY: C. C. McCULLOH, Attorney General

TO: W. W. Nichols, Chairman New Mexico Public Service Commission Santa Fe, New Mexico

{*38} In your letter dated April 21, 1947, you refer to Section 8, Chapter 214, Laws of 1947, which provides that the persons coming under the provisions of the Act shall, at the time of issuance of the license and annually thereafter, on or before June 30 of each calendar year, pay to the Commission a fee of $ 50.00. You inquire whether payments made prior to June 30 this year will extend only to June 30, 1947, or whether the fee covers the year 1947 or until June 30, 1948.

Since the law provides for annual payments on or before June 30 of each calendar year, it seems apparent that the Legislature intended the payment of $ 50.00 to cover the balance of the calendar year for which license is issued and payments thereafter, although required to be made on or before June 30, would cover fees for each calendar year.

You are being directed to the most recent version of the statute which may not be the version considered at the time of the judgment.
