Opinion No. 53-5670

February 13, 1953

BY: RICHARD H. ROBINSON, Attorney General

TO: Mr. E. A. Medina, President Northern New Mexico Normal School El Rito, New Mexico

{*62} In your letter dated February 12, 1953, you inquire whether teachers of the Northern New Mexico Normal School come under the Teacher Tenure Law pertaining to public school teachers. I am enclosing a copy of Opinion No. 4342, dated July 23, 1943, relative to this matter {*63} in connection with the New Mexico Institute for the Blind. Since your school is an educational institution under jurisdiction of the Board of Regents this opinion would be applicable to the teachers employed by the Board of Regents and such teachers do not come under the Teacher Tenure Law.

Sec. 55-111 of the 1941 Compilation, Pocket Supplement, only gives tenure to teachers employed by school boards of school districts, whether rural, municipal or otherwise, and does not apply to state educational institutions.
