Opinion No. 53-5797

August 6, 1953

BY: RICHARD H. ROBINSON, Attorney General

TO: Mr. Floyd Santistevan Assistant Superintendent of Public Instruction Santa Fe, New Mexico

{*207} In your letter dated July 28, 1953, you enclosed a letter from Mr. T. C. Bird, Superintendent of the Santa Fe City Schools, requesting an opinion concerning the power of a Municipal Board of Education to purchase a future school site outside the present school district limits.

Municipal Boards of Education are given the same powers held by County Boards of Education relative to rural school districts which include the supervision and control of school sites, buildings, equipment and funds of said district. There is no prohibition against anticipating future needs for school purposes and acquiring school sites outside the limits of the present school district, by a Municipal Board of Education.
