TO: Mr. Joseph B. Grant, State Treasurer, Santa Fe, New Mexico

You have forwarded to this office a tabulation of distribution of motor vehicle fees for the period ending June 10, 1955, which was received by your office on June 23, 1955, from the Bureau of Revenue. This tabulation provides for distribution under Section 64-11-12 of the 1953 Compilation, as it existed prior to the effective date of Chapter 277, Laws of 1955.

You ask whether in view of the fact that the actual physical distribution of such revenues will occur after the effective date of Chapter 277 changing the formula for distribution, the new formula should be used.

Chapter 277 commences as follows:

"The fees collected under the provisions of this Act . . ."

We feel that this language limits the effect of the new distribution formula to monies collected subsequent to June 10, 1955, and that it is proper for you to distribute monies collected prior to that date under the provisions of the prior law, although the actual physical distribution takes effect subsequent to the effective date of the new statute.
