TO: Mrs. Natalie Smith Buck, Secretary of State, Santa Fe, New Mexico

We are in receipt of your inquiry of December 7 concerning the affidavit form contained under § 3-2-7, N.M.S.A., 1953 Compilation.

The form is set out and the statute says in relation to that form the following:

"The affidavit of registration shall be in substantially the following form:"

Elsewhere in the statute, the Secretary of State is directed to furnish affidavit forms to all county clerks. This is with the obvious intention that the affidavit of registration forms will be uniform throughout the State. The form presently employed by the Secretary of State is in exactly this form.

The completed affidavit must contain each of the essential elements contained in that form and any omission of any of the essential elements would be fatal to the person's registration. The entire form must be completed before an effective registration is accomplished.
