Opinion No. 56-6506

August 10, 1956

BY: RICHARD H. ROBINSON, Attorney General

TO: Mr. James C. Compton, Assistant District Attorney, Ninth Judicial District, Portales, New Mexico

In reply to your letter of August 1, 1956, in which you raise the question of whether a court reporter may not be paid a straight salary instead of the method provided in Section 16-3-46, N.M.S.A., 1953 Compilation, Pocket Supplement, this is to inform you that that method of payment of court reporters as provided in Section 16-3-46, is exclusive, and any other method and computation of salary would be in violation of the law.

If this method of salary payment is not proving satisfactory, any relief will have to come through legislative enactments.

Trusting we have fully answered your inquiry, we remain

By: Harry E. Stowers, Jr.
