TO: Mr. Marshall S. Hester, Superintendent, New Mexico School for the Deaf, 1060 Cerrillos Road, Santa Fe, New Mexico

You have asked for our opinion on the question as to whether or not the Land Commissioner may issue leases on State Trust Lands of which your Institution is the beneficiary, for a period exceeding ten years.

I can find nothing in the Enabling Act, our State Constitution, or our Statutes which prevents him from doing this. So long as the advertisement and public auction provisions of the Enabling Act are met and the proper applications are made therefor, it is our opinion that such leases may be executed.
