QUESTION

Can the State Park and Recreation Commission, pursuant to Chapter 135, Laws of 1969, transfer $ 72,533.28 to the City of Clovis to be used for recreational facilities appurtenant to the dam and reservoir to be constructed at Running Water Draw?

CONCLUSION

Yes.

OPINION

{*11} ANALYSIS

The 1969 Session of the New Mexico Legislature enacted Chapter 135, transferring all money remaining from the {*12} appropriation made by Laws 1955, Chapter 287, Section 7, for the construction of Running Water Draw dam to the State Park and Recreation Commission.

The money is to be disbursed upon vouchers signed by you.

I am advised by the Director of the Department of Finance and Administration, that upon receipt by him of a duly executed voucher in the sum of $ 72,533.28 to the City of Clovis, disbursement will be forthcoming.
