QUESTIONS

QUESTIONS

1. Are provisions of Section 77-4-1.3(B), NMSA, 1953 constitutional and valid in view of the creation of two new offices, one of which term does not expire until 1973?

2. If such dated term is held invalid, would the remaining provisions of said Section continue in force?

3. Can a school board in the State of New Mexico increase its membership under said Section after 1 February 1971?

1. Yes.

2. Not applicable.
