This question has been raised on a number of occasions in the State of New Mexico.

I direct your attention to Attorney General Opinion No. 57-93 which addresses itself to the same problem. The analysis contained therein is appropriate to the conclusion reached herein as the constitutional and statutory provisions remain substantially the same now as they were in 1957 when the attached opinion was written by this office.
