No license required to peddle maps.

OPINION

{*94} I have just received your letter of the 11th inst., which appears to have been delayed on the road. You ask me if the state laws of New Mexico permit of peddling a small map of Mexico and whether county officers have the power to grant you authority to sell in their counties.

By Chapters 107 and 128 of the Laws of 1905, heavy licenses are imposed upon peddlers, but it is provided that the provisions of the acts "shall not apply to the sale of books, papers, school supplies or household machinery." I incline to the opinion that the law would not require the taking of any license in order to sell your small map of Mexico and that the proviso just quoted would be considered broad enough to cover such a map. This being so, no authority would be required from county officers for you to sell your map in their county.
