Opinion No. 14-1335

September 23, 1914

BY: FRANK W. CLANCY, Attorney General

TO: Mr. H. S. Fuller, Fort Sumner, New Mexico.

TRAVELING EXPENSES.

Traveling expenses of member of county road board should be paid.

OPINION

{*198} I have received your letter of the 23rd instant in which you, as a member of the county road board, ask whether you are entitled to traveling expenses and for time required to attend meetings of the board. The law distinctly provides that the members shall serve without compensation, but I am of opinion that traveling expenses, including necessary hotel bills, should be paid by the board from the fund under its control, but no allowance can be made for the time required to attend the meetings, as that would be in the nature of compensation to the members.

You further ask whether you are entitled to pay for overseeing men while at work while on the roads, and as to this I feel compelled to say that any compensation for your services in any matter connected with the work of the road board falls within the prohibition in the statute and cannot properly be allowed.

You are being directed to the most recent version of the statute which may not be the version considered at the time of the judgment.
