Traveling expenses of county commissioners and probate judges.
OPINION
{*70} I have just received your letter of the 27th inst. in which you ask my opinion as to whether the provision in the county salary bill providing that county commissioners and probate judges shall be allowed actual and necessary traveling expenses in attending meetings of their respective boards or courts, when residence is away from the county seat, includes hotel bills. I am of opinion that this must include hotel bills on the road and at the county seat both. It would be an unreasonable construction to hold otherwise as the obvious intent of the legislature was to reimburse these officers for actual and necessary expenses incurred in attending meetings when those officers lived away from the county seat. If it could be held otherwise, then they would be put to extra expenses without reimbursement, which appears not to be in accordance with the intention of the legislature.
