Legal rate for publications in newspapers.
OPINION
{*192} I have just received your letter of the 14th inst. asking me to advise you as to what is the legal rate for publication of state selections, land sales, etc.
The statutory limit for the publication of all notices and other matters required by law to be made, is thirty cents per hundred Ems of the type in which the notice is set for the first insertion, and twenty cents per hundred for each subsequent insertion. You will find the law on this subject in Section 4645 of the new codification of our statutes, a copy of which should be in the office of your justice of the peace, or in Section 2 of Chapter 49 of the Session Laws of 1912. The effect of the statute is to prevent the charging of higher rates, but does not necessarily require the payment of the rate fixed if publication can be made at any lower rate.
