Opinion No. 20-2459

January 9, 1920

BY: N. D. MEYER, Assistant Attorney General

Justice of the Peace Practicing Law.

OPINION

In compliance with our understanding of a few days ago, I am herewith giving you my opinion relative to the proposition of whether or not one justice of the peace may practice before a justice of the peace in another precinct.

I have made quite an extended research and find no inhibition of law against one justice of the peace practicing before another.

The only law which is of any assistance in the premises states that no one may practice before any court of this state, except the probate court or the justice of the peace unless he is a licensed attorney, and from this language it is to be inferred that the justice of the peace may practice before the probate court or another justice of the peace court, in the absence of any expressed provision of law to the contrary.

You are being directed to the most recent version of the statute which may not be the version considered at the time of the judgment.
