Opinion No. 20-2549

March 1, 1920

BY: O. O. ASKREN, Attorney General

TO: Mr. B. Ruppe, 203 West Central Avenue, Albuquerque, New Mexico.

Pharmacists Prohibited From Filling Prescriptions for Alcoholic Beverages.

OPINION

In reply to your letter of February 27th, requesting my opinion as to whether the law prohibits the filling of prescriptions for whisky, brandy, or other wines or liquors, when the same are written by a registered physician, and the pharmacist is acquainted with the person taking the same, I advise that pharmacists are prohibited from filling prescriptions for whisky, brandy, wines and all other liquors, except grain alcohol.

The constitution permits only the sale of grain alcohol for medicinal purposes, and wines only for sacramental purposes.

You are being directed to the most recent version of the statute which may not be the version considered at the time of the judgment.
