Opinion No. 20-2519

March 19, 1920

BY: HARRY S. BOWMAN, Assistant Attorney General

TO: Hon. Manuel Martinez, Secretary of State, Santa Fe, N.M.

Motor Vehicle Licenses Transferable.

OPINION

Upon my return, after an absence from the city of several days, I find upon my desk your letter of March 10th requesting an opinion from this office regarding the right to transfer or assign a dealer's motor vehicle license, and refer to Section 22 of Chapter 150 of the Laws of 1919.

In our opinion a dealer in motor vehicles has a right to transfer or assign his license if he so desires, as there is no prohibition in the act against his so doing, and it would require specific legislation in order to prevent him from transferring the license in the event that it was intended that he should not have that power.

You are being directed to the most recent version of the statute which may not be the version considered at the time of the judgment.
