Opinion No. 20-2600

June 1, 1920

BY: N. D. MEYER, Assistant Attorney General

TO: Honorable Thomas P. Gable, State Fish and Game Warden, Santa Fe, New Mexico.

Permit to Ship Deer Heads and Hides Not Necessary. Packages Should Be Marked.

OPINION

We have your letter of May 28th in which you state that the question of whether or not it is necessary, in shipping from one state to another the head and hide of deer to have a shipping permit attached to the shipment, has come up in your office several times and asking that we render an opinion on said subject.

It hardly appears to us that Section 2468 to which you refer would give the State Game Warden of this state authority to require permits to be attached to shipments of deer heads and hides interstate. However, we believe that Section 2459 which requires that a certificate or permit be attached to the outside covering of a package containing any game or fish in transportation, is broad enough to reach such shipments as that of deer heads and hides. In compliance with this section the shipper or consignor should mark or label the box or package which contains the head and hide or either, so as to indicate the true contents, in addition to the certificate or permit from your office, which should be attached as hereinabove stated.

You are being directed to the most recent version of the statute which may not be the version considered at the time of the judgment.
