Opinion No. 20-2626

June 28, 1920

BY: N. D. MEYER, Assistant Attorney General

TO: Honorable Manuel Martinez, Secretary of State, Santa Fe, New Mexico.

Pro Rata Fee For Dealer's Automobile License.

OPINION

We have your letter of June 25th in which you refer to the Motor Vehicle Law and ask if your office can pro rate fees charged for dealers' licenses taken out after July first of each year.

Answering your question we beg to advise that any manufacturer or dealer in motor vehicles in the state, in lieu of registering each vehicle, may secure a dealer's registration number for which he shall pay $ 25.00, and that all other provisions of the Motor Vehicle Act shall apply in each case of dealers' registration.

One of the provisions of the Act is that all applicants for registration or annual license of motor vehicles filed after June 30th of any year shall be required to pay one half of the annual fee.

Under the above provisions of the law we are of the opinion that a dealer who applies for a dealers' registration number after July first can be required to pay only one half of the license fee, towit $ 12.50.

You are being directed to the most recent version of the statute which may not be the version considered at the time of the judgment.
