Woman Eligible to Hold Office Assistant Commissioner Public Lands.

OPINION

In reply to your letter of December 6th, wherein you request an opinion concerning whether a woman is eligible to the office of Assistant Commissioner of Public Lands, advise:

Section 11, Article XX, of the Constitution of New Mexico provides:

"Women may hold the office of Notary Public and such other appointive offices as may be provided by law."

Section 3953 of the Code of 1915 provides:

"Women may hold any appointive office in the State of New Mexico."

The Assistant Commissioner of Public Lands, being an appointive office, it is, therefore, clear, under the Constitution and said statutory law, a woman is eligible to hold this office.
