Opinion No. 21-2968

May 13, 1921

BY: HARRY S. BOWMAN, Attorney General

TO: Miss Lillian Franzen, Superintendent Girls' Welfare Home, 611 South Broadway, Albuquerque, New Mexico.

Personal Belongings of Escaped Inmates of Girls' Welfare Home.

OPINION

{*55} I have your letter of the 6th instant requesting information regarding your authority in connection with the delivery of property belonging to an escaped inmate of your institution upon the request of a brother of the girl for a delivery to him of such property.

You would have no authority whatsoever to deliver any property belonging to a person or former inmate of your institution, except upon proper showing that the person making the request is entitled to receive the same.

The girl mentioned in your letter, being a minor, should have had a guardian of her property appointed by the proper tribunal, and it is only to such person that you would be authorized to deliver the property of such former inmate.

You are being directed to the most recent version of the statute which may not be the version considered at the time of the judgment.
