Opinion No. 21-2978

May 19, 1921

BY: HARRY S. BOWMAN, Attorney General

TO: Mr. N. C. Frenger, Board of Regents, New Mexico College of Agriculture and Mechanio Arts, Las Cruces, New Mexico.

Board of Regents of Agricultural College May Lease School Property.

OPINION

{*59} In reply to your letter of the 17th instant, asking if the Board of Regents of your institution would be authorized to lease a small portion of the college lands to a party desiring to erect a fluorspar treating mill, I would say:

Section 5176, Code 1915, wherein the University of New Mexico, the New Mexico Agricultural College, and the New Mexico Insane Asylum are specifically authorized to buy and sell or lease or mortgage realty for the benefit of the institution and to do all things that in the opinion of the boards will be for the best interests of said institutions, in my opinion specifically authorizes the boards of these institutions to lease a part of the school property if found to be advisable.

You are being directed to the most recent version of the statute which may not be the version considered at the time of the judgment.
