Qualifying to Do Business By Common Law Trusts.

OPINION

{*77} I have your letter of the 15th instant enclosing correspondence from the Magnolia Petroleum Company and requesting an opinion as to whether this Company can be required to qualify as a corporation in New Mexico.

The Magnolia Petroleum Company is a joint stock association and there is nothing in the laws of the state of New Mexico which requires such an association to qualify as a corporation.

In my opinion, therefore, the Company may operate in the state without filing its articles of association in your office.

The question as to whether such an association may sue in New Mexico is one which I am not prepared to pass upon at this time, as that is not a matter involved in your inquiry.

I am returning herewith the correspondence which was attached to your letter.
