Probate Clerk to Furnish Without Cost Copies Records of Court to State Tax Commission For Inheritance Tax Purposes.

OPINION

{*82} I have your letter of the 4th instant, enclosing copies of correspondence with the State Tax Commission regarding the furnishing {*83} of copies of records of the Probate Court in connection with the succession of property, and note that you object to the furnishing of the information and the copies of the records required without payment therefor.

As these records are to be furnished either by the Probate Judge or Probate Clerk, and as they are to be supplied to a state agency for state purposes, no charge may be made by the county clerk for the services rendered in supplying the data.

You are required to furnish only such information as the law designates, and the Probate Judge must furnish such as the law requires from him.

I am returning to you herewith the marked copy of the pamphlet which accompanied your letter.
