Holding of Office by Women.

OPINION

{*114} In reply to your letter of the 19th instant, requesting an opinion regarding the holding of office in this state by women, and referring to Constitutional Amendment No. 1, ratified by the people at the election held on September 20, 1921, I wish to advise you as follows:

You will note from a reading of the amendment that the disqualification to hold office which previously existed because of sex has been removed by the provisions thereof, and that women are qualified to hold office under the amendment the same as are men.

For the foregoing reasons, it is apparent that no action of the legislature is necessary to authorize women to hold public office, but that since the ratification of the amendment by vote of the people, members of both sexes stand equally before the law in the matter of holding public office.

It is my opinion that women are now eligible to hold any office in this state, the same as are members of the male sex.
