May 1, 1922

BY: HARRY S. BOWMAN, Attorney General

TO: Mr. Roman Atencio, Dixon, New Mexico.

Payment Members Registration Boards, Judges and Clerks of Election.

OPINION

{*149} Your letter of the twenty-second of April addressed to Hon. Manuel Martinez, Secretary of State, making inquiry concerning the method of payment of members of boards of registration and judges and clerks of election has been referred to this office for attention.

I assume you refer to the last election, meaning the election held for municipal officers on April 4th.

Payment for members of boards of registration as provided for in Section 1971 and of judges and clerks of elections, as provided for in Section 1991, Code 1915, must be paid by the towns, cities or villages for services rendered in connection with municipal elections.

If the reference in your letter is to school elections held on April 3rd, the officers conducting such elections are not entitled to any compensation for such services. See Section 1991, Code 1915.

You are being directed to the most recent version of the statute which may not be the version considered at the time of the judgment.
