Members National Guard Entitled to Pay When Receiving Compensation as Civil Employes of State.

OPINION

{*171} Your office has referred to us the question as to whether men and officers in a National Guard who are civil employes of the State, may receive their pay from the State for such civil employment and at the same time receive the compensation allowed to them by law while they are in active service for the State as members of the National Guard.

We believe that under the opinion of our Supreme Court in the case of State vs. Blancett, 24 N.M. 433, there is nothing in our statutes which prohibits such payments being made.
