Opinion No. 22-3651

December 21, 1922

BY: HARRY S. BOWMAN, Attorney General

TO: Mr. W. Davis Vestol, Farmington, New Mexico.

Allowance for Probate Judges Does Not Include Traveling Expenses.

OPINION

{*193} In reply to your letter of the 12th instant, received today, asking if the allowance for traveling expenses for Probate Judges includes expenses incurred for hotel bills, I beg to advise you that in my opinion the last paragraph of Section 4, Chapter 12, Laws 1915 (the salary law) which allows to county commissioners and Probate Judges "actual and necessary traveling expenses in attending meetings of their respective boards or courts when residence is away from the county seat," does not authorize the payment of expenses for hotel bills in connection with services as such officials.

You are being directed to the most recent version of the statute which may not be the version considered at the time of the judgment.
