Opinion No. 23-3674

February 21, 1923

BY: JOHN W. ARMSTRONG, Assistant Attorney General

TO: Requested by: Hon. Coe Howard, Representative of Roosevelt County, February 21, 1923.

Certain Powers Heretofore Vested in Board of Regents of Agricultural College May be Now Vested in Boards of County Commissioners.

OPINION

{*19} You ask whether or not House Bill 149, amended so as to relieve the Regents of the Agricultural College of New Mexico of its powers and duties and to impose such powers on and invest the same in the various Boards of County Commissioners, will be constitutional.

{*20} We have made a casual research of the authorities and have concluded such an amendment would in no wise affect the constitutionality of the act. These powers may be vested in the Board of County Commissioners the same as in the Board of Regents.

You are being directed to the most recent version of the statute which may not be the version considered at the time of the judgment.
