Opinion No. 25-3847

August 11, 1925

BY: JAMES N. BUJAC, Assistant Attorney General

TO: Requested by: Hon. D. H. Wolford, Assistant District Attorney, Magdalena, N.M.

Salaries of County Officers cannot be paid monthly.

OPINION

You request an opinion as to whether or not the salaries of County Officers can be paid monthly instead of quarterly.

§ 14, Chapter 12, Session Laws of 1915, provides:

"Except as hereinbefore and hereinafter otherwise provided, the salaries of all county officers, and salaries of deputies, fixed by them and by this act, and expenses by this act authorized, shall be paid quarterly out of the County Salary Fund, upon warrants drawn by the county commissioners. All salaries fixed by this act and all expenses herein and hereby authorized shall be paid from the respective dates upon which the several county officers qualified."

In view of the above provisions of the law it is my opinion that the salaries of county officers cannot be paid monthly but must be paid quarterly as provided by law.

You are being directed to the most recent version of the statute which may not be the version considered at the time of the judgment.
