TO: Requested March 17, 1925, by Honorable E. B. Swope, Commissioner of Public Lands, Santa Fe, New Mexico.

No law requiring Capitol Custodian Committee to let insurance on Capitol to local insurance agents.

OPINION

I quote your inquiry as follows:

"Will you please advise me at your convenience your opinion with reference to the Capitol Custodian Committee whether or not they are compelled by law to give insurance on the Capitol Buildings to local agents here in Santa Fe or whether insurance policies could be taken out with Insurance agents over the State."

After casual examination of the Statues, I find no law requiring the Capitol Custodian Board to insure State property with Santa Fe Agents only. Such an act of the Legislature, if it existed, would probably be unconstitutional.
