Opinion No. [29-21]

January 9, 1929

TO: Office of the Attorney General of New Mexico

COUNTY OFFICERS -- Sheriff not paid by state for transporting juvenile to reform school.

OPINION

Your request of January 8 in re payment of expenses of sheriff of San Miguel County for transportation of juvenile prisoners to the Reform School at Springer, N.M., is at hand, and in reply thereto beg to advise that the provision of Section 3, Chapter 12, of the Session Laws of 1915 only provides for the payment of the expenses of transportation of prisoners to the State Penitentiary and is not broad enough to include anything else. Hence these fees cannot be paid by the State out of any fund.

You are being directed to the most recent version of the statute which may not be the version considered at the time of the judgment.
