TO: Mrs. Emma McDonald, Village Clerk, Lovington, New Mexico.

SCHOOLS AND SCHOOL DISTRICTS -- Election for school board in municipal district held only in odd numbered years.

§ 120-904, Code 1929.

OPINION

I have before me yours of the 16th inst. in which you ask to be advised as to what steps should be taken to elect or appoint a new school board.

You do not say whether or not your school district is municipal or otherwise and from your letter I gain but little information on that subject. Your letterhead indicates that Lovington is a city and yet it shows a list of names under the heading, Trustees, with also a Mayor and Secretary. You also sign yourself Village Clerk and make reference to an outgoing City Council, which failed to call an election for a school board at the regular time.

If yours is a municipal school district, as I assume it is, elections for school board are held only in each odd numbered years consequently there is no election called for in 1930. See section 120-904, Codification of 1929.

If you will be so kind as to write again giving me more definite information as to the situation and answering such questions as are suggested in the second paragraph of this, I shall be pleased to advise to the best of my ability.
