TO: Mr. W. R. Eccles, State Highway Engineer, Santa Fe, New Mexico.

{*105} Your letter of September 18th calls for a construction of that part of Section 1 of Chapter 124 of the Laws of 1931, and that part of Sections 1 and 2 of Chapter 38 of the Laws of 1917, which reads as follows:

"No member of the commission shall receive compensation or expenses, for more than ninety days in the aggregate during any one year."

It is our opinion that this provision is applicable to the several individual members of the commission. {*106} It is provided that the members of the commission shall receive the sum of $ 8.00 per day while actually engaged in the discharge of their duties as members of the commission, and also their actual and necessary expenses when traveling on business of the commission.

It was, evidently, the intention of the legislature to provide a certain compensation for the members of the commission and to limit such compensation to a ninety day period for each member in the aggregate.
