Opinion No. 31-284

September 28, 1931

BY: E. K. Neumann, Attorney General

TO: Mr. Adolf J. Krehbiel, Attorney at Law, Clayton, New Mexico.

{*111} This is in reply to your letter of September 25, 1931, in regard to the distribution of the state common school current fund among the various school districts of Union County.

So far as I know, this office has not officially expressed an opinion upon the question raised by Mr. Watkins.

Section 4 of Article 12 of the State Constitution is very plain upon this subject. The fund must be distributed "in the proportion that the number of children of school age in each district bears to the total number of such children in the state."

Consequently, it is the opinion of this office that the state common school current fund should be apportioned in accordance with Section 4 of Article 12 of the Constitution.
