Opinion No. 32-369

January 30, 1932

BY: Quincy D. Adams, Asst. Attorney General

TO: Mrs. Georgia L. Lusk, Supt. of Public Instruction, Santa Fe, New Mexico.

{*133} This is in reply to your letter of January 29th, 1932, in which you request an opinion upon the questions asked in the letter of Mr. J. Ethan Wright of Valedon, New Mexico, dated January 22nd, 1932. I believe that the questions asked by Mr. Wright are answered in Section 120-1414, 1929 Code, copy of which is as follows:

"Except as otherwise provided by law, all property belonging to school districts and all property the title of which or may be vested in the board of education, shall not be sold, transferred or disposed of, except for cash or its equivalent and with the written consent of the superintendent of public instruction."

If, after reading this section, Mr. Wright is not fully satisfied, we will be glad to answer any further questions he may ask concerning this matter.

You are being directed to the most recent version of the statute which may not be the version considered at the time of the judgment.
