Re: Santa Fe County Debt Refunding Bonds -- Series B.

OPINION

{*149} You have asked this office for an opinion as to whether or not the above mentioned bonds, if redeemed at the option of the state before maturity, must be redeemed in numerical order. By the terms of the bonds themselves and under the provisions of Section 9, Chapter 16, Laws of 1912 such bonds may be redeemed at the option of the state at any time after twenty years from their date. It appears that the bonds of this series all mature on July 1, 1953 and were issued on July 1, 1913. No priority or preference is given to bonds bearing low numbers either by the terms of the bonds themselves or by said Chapter 16, Laws of 1912. It is therefore my opinion that it is not necessary that these bonds, if redeemed before maturity at the option of the state, be redeemed in numerical order.
