Opinion No. 35-1235

December 11, 1935

BY: FRANK H. PATTON, Attorney General

TO: Mr. George M. Biel, Superintendent of Insurance, Santa Fe, New Mexico.

{*90} This is in reply to your letter of December 11, 1935. The requirements for a company to be licensed to transact a fire and general business, as provided in Chapter 114, Laws of 1935, seem to be the same as the requirements for transacting an accident, casualty, guarantee, etc., business except in the latter case of a deposit of $ 25,000.00 is required. If this deposit is made, I should think that a company might be licensed to transact fire insurance business as well as one or more of the kinds of insurance mentioned in the fourth paragraph of said Chapter 114. However, the grouping mentioned in Section 71-152 should be observed as far as it is applicable.
