TO: Mr. Fay Guthrie, Executive Secretary, Bureau of Public Welfare, Santa Fe, New Mexico.

{*115} Your letter dated April 26, 1936, is hereby acknowledged. You state:

"At the last meeting of the Board of the State Department of Public Welfare the Board of Directors accepted the resignation of Mrs. Irene Farnham Conrad, and in lieu of thirty days notice they granted her a month's salary instead. Please advise whether or not we are conflicting with any provision of the state laws by paying this salary in advance."

We find no statutory provision pertaining to the payment of salaries in advance. It is, therefore, our opinion that the salary, as set forth in your letter, may be paid.
