{*30} We have your letter of October 24th asking our advice with regard to certain provisions of the Social Security Act. You state in your letter that the Social Security Act provides that a state plan for all assistance shall be in effect in all political subdivisions of the state.

You ask whether or not Indian reservations or pueblos are to be considered as political subdivisions of the state. It is our opinion that such Indian reservations and Indian pueblos in New Mexico are under no circumstances to be considered as political subdivisions of New Mexico and we therefore believe that it is not obligatory upon your department to have plans of assistance effective in such Indian reservations and pueblos.
