{*39} Your letter of December 14th inquires as to the legality of Assistant District Attorneys accepting passes from railroad companies.

Insofar as District Attorneys are affected, this matter is covered by Section 14, Article 20 of the State Constitution, but we are unable to find any other anti-pass legislation in our statutes and feel that railroads may freely issue passes to others not included in the constitutional enumeration.

For this reason I see no legal objection to your acceptance of a pass from the Santa Fe Railroad Company in your capacity as Assistant District Attorney.
