Opinion No. 37-1685

June 23, 1937

BY: FRANK H. PATTON, Attorney General

TO: Miss Billy Tober State Registrar and Bookkeeper Bureau of Public Health Santa Fe, New Mexico

{*128} This will acknowledge receipt of your letter dated June 21st wherein you ask for an interpretation of that portion of Section 11, Chapter 39, Laws of 1937, providing as follows:

". . . . all original birth and death certificates filed with the county clerks prior to January 1, 1920, shall be transmitted by the County Clerks to the Director on or before July 1, 1937."

Under said section of law, as it now reads, the various county clerks apparently have no choice other than to transmit such original birth and death certificates to the Director of Public Health; this should be done prior to July 1, 1937.

Asst. Atty. Gen.
