Opinion No. 39-3109

April 20, 1939

BY: FILO M. SEDILLO, Attorney General

TO: Hon. Cruz R. Alvarez, Vice President, Las Cruces Union High School Board, Las Cruces, New Mexico.

{*39} This office is in receipt of your telegram of April 20 requesting information as to whether or not the Union High School Board is authorized by law to enter into legal contract with its superintendent and teachers for a period of five years.

This is to advise you that the school laws of New Mexico do not authorize boards of education to contract with superintendents or teachers for a period of five years. In Opinion No. 1017 on this same question, this office ruled:

'We find no specified provision as to the term of office of the superintendent. It is our opinion that his term of office may be for a reasonable length of time, which would include a period of two or three years."

With best wishes, I am,
