Opinion No. 39-3277

September 15, 1939

BY: FILO M. SEDILLO, Attorney General

TO: Mr. James M. H. Cullender, Attorney at Law, Roswell, New Mexico.

{*104} In your letter of September 12th you inquire as to the compensation to be received by the registration clerks under Section 25, Chapter 152 of the 1939 Laws.

This office has held that registration clerks are to be paid for all registration affidavits which are filed by the County Clerk and the registration board shall certify the proper number for payment when determined by themselves or their clerk. Further, that registration clerks shall "each" receive "as compensation the sum of 10c for each person so finally registered." Each clerk is to be paid 10c in rural districts and 5c in municipal corporations for each person registered.

Personal dealings between the clerks, of {*105} course, is not a matter that should be decided by either the board of registration or the county commissioners.

You are being directed to the most recent version of the statute which may not be the version considered at the time of the judgment.
