TO: Mr. W. B. O'Donnell, Dean of Students, N.M. State College of Agriculture and Mechanic Arts, State College, New Mexico.

{*134} In your letter of January 10th you ask whether or not the New Mexico State College may suspend a student from the college for conduct detrimental to the reputation of the institution, also with regards to a regulation which you have that all students must live in approved homes.

Section 130-1001, New Mexico Statutes, Annotated, 1929 Compilation, in part reads as follows:

"The New Mexico College of Agriculture and Mechanic Arts shall be an institution of learning open to the children of all the residents of this state, and such other persons as the board of regents may determine, under such terms, rules and regulations as may be prescribed by said board of regents.'

The board of regents has the power to enact laws, rules and regulations for the government of the college and may make reasonable rules and regulations for the government and discipline of the students.
