TO: Mr. Walter J. Robertson Superintendent of City Schools Las Vegas, New Mexico

{*141} In your letter dated January 5, 1942, you state that the Las Vegas City Schools are planning to initiate a program of military training for high school boys in connection with its physical education program, and you wish to know whether such military training may be made compulsory for all boys except those excused by doctors' certificates.

Such training may be made a part of your physical education program, and under the general powers of the board, participation in such training could be made a requirement for graduation. However, I do not believe that such training may be made compulsory for all boys, in view of the fact that there is no statutory authority authorizing school boards to take such action. It may be that a student does not wish to graduate, and for that {*142} reason, would not care to take the required training as may be set up by your board. In such event, I do not believe you could compel such student to take this training.
