{*154} In your letter dated January 28, 1942, you request an opinion from this office relative to the necessity of obtaining a contractor's license before a bid may be submitted by a contractor.

Chapter 197, Sections 1 and 3, Laws of 1939, require that a contractor secure a license from the State Board before he offers to act as a contractor or purports to have the capacity of a contractor. Under that language, it is a violation of the law to submit a bid to perform certain work coming within purview of this law without first obtaining a contractor's license.

This conclusion is in accord with Opinion No. 3637, a copy of which I am enclosing herewith for your information.
