Opinion No. 43-4401

October 30, 1943

BY: EDWARD P. CHASE, Attorney General

TO: Miss Dorothy W. Miller, Secretary, State Board of Cosmetologists, 209 First National Bank Bldg., Albuquerque, New Mexico

In your letter dated October 29, 1943, you inquire whether a person may secure a license as an electrologist without qualifying for a license in all branches of beauty culture, when it is desired to practice electrolysis only.

Section 51-2003 of the 1941 Compilation, sub-section B, provides as follows:

"A limited certificate of registration or license to practice as an electrologist only may be applied for and granted under all the terms and conditions of subsections (a), (b), (c), (d) and (e), of this section and who has passed a satisfactory examination conducted by the board of cosmetology to determine his or her fitness to receive a certificate of registration as an electrologist."

From this language it seems to be clear that a license to practice as an electrologist only may be applied for and granted pursuant to the statute.

Section 51-2006 gives you authority to grant licenses to persons registered under the laws of another State, who otherwise meet the requirements.

First Asst. Atty. General
