TO: Honorable J. L. Leftow, Assistant District Attorney, Hot Springs, New Mexico

Replying to your letter dated April 11, 1944 requesting an opinion regarding the last date on which the Declarations of Candidacy may be filed before the primary election. This office has recently held in Opinion Number 4482 that when the last day of registration falls on Sunday, the books should remain open on the following day. The same rule would apply when the last date for filing Declarations and Petitions falls on Sunday. The time should be extended to include the following Monday.
