TO: Mr. J. Wilbur Jones, Engineer, Electrical Administrative Board, P. O. Box 386, Albuquerque, New Mexico

We are in receipt of your letter of June 12, 1944 in which you ask our opinion as to whether the Electrical Board may require electrical contractors to file a surety bond at the time of making application for license.

You will note that Section 51-2208 establishes the terms and conditions upon which electrical contractors' licenses shall be issued. This section does not require the filing of any bond as a condition to the issuance of the license. Nor does any other provision of the electrical code authorize or require such bond. While by Section 51-2204 of the 1941 Compilation the Electrical Board is given authority to adopt rules and regulations and to issue orders, such powers are limited to the enforcement of the provisions of the Electrical Code.

In view of the foregoing, it is my opinion that you are not authorized to require such bond.
